Terms

Terms of service

These terms are an agreement between you and PatrolX Technologies Pty Ltd of Melbourne, Australia (“we”, “us”), for using Tella, the website at tellasocialbot.com and the Tella app. By creating an account or starting setup, you agree to them. We've kept them in plain English.

1. What Tella does

Tella turns the photos, clips and text you send into social media posts and videos, and publishes the ones you approve to the accounts you've connected through Buffer. What each plan includes is on the pricing page. We may improve or change features over time; if a change materially reduces what your paid plan includes, we'll tell you first.

2. Your account

  • You must be at least 18 and able to agree to these terms for yourself or the business you sign up for. If you sign up for a business, you confirm you're allowed to act for it.
  • You sign in with codes sent to your email. Keep access to that email secure: anyone who can read it can sign in.
  • The account owner can add other people to the business. You're responsible for what the people you add do in Tella.
  • Give us accurate details, and tell us if they change.

3. Approval and responsibility for posts

Nothing is published without your approval. When you approve a post, you're the one publishing it: you're responsible for checking it's accurate, lawful and right for your business, including any prices, offers, claims and the people or property shown. Tella is a tool that drafts and publishes for you; it doesn't give legal, financial, health or advertising-compliance advice. AI-generated drafts can contain mistakes, so read before you approve.

4. What you can and can't send

You must have the right to everything you send Tella. Don't use Tella to make or publish anything that:

  • infringes someone else's copyright, trade marks, privacy or other rights;
  • shows a person who hasn't agreed to appear, where their agreement is needed;
  • is misleading or deceptive, including false reviews, testimonials or claims about your products;
  • is unlawful, defamatory, discriminatory, hateful, sexually explicit, or harassing;
  • breaks the rules of the social networks or Buffer.

We may decline to make a post, and may suspend an account that breaks these rules.

5. Avatars and cloned voices

  • An avatar and cloned voice are made only of a person who records the setup footage themselves and gives their consent. You confirm that person has agreed to Tella using their likeness and voice for your business's posts.
  • Each business has one voice, belonging to that person. You may not use Tella to imitate anyone else.
  • The person can withdraw consent at any time by telling us; we'll then stop making videos with their avatar and delete it.

6. Your content

You keep ownership of what you send and of the posts and videos made for you. You give us permission to store, process and adapt your content, and send it to our service providers, only as needed to run Tella for you, and to publish what you approve. We don't use your content to advertise Tella or train AI models without your separate permission. How we handle personal information is in the privacy policy.

7. Connected accounts

Publishing works through your own Buffer account and the social networks you connect to it. Those services have their own terms, which you agree to with them. We're not responsible for their outages, rule changes or decisions, such as a network rejecting or removing a post. You can disconnect Tella at any time by deleting your Buffer API key.

8. Free trial

The free trial includes 5 photo posts and needs no card. If you choose to feature a trial post on Tella's demo Instagram account instead of your own, you agree to it appearing there; ask us and we'll take it down. We may change or end the free trial offer at any time.

9. Fees and payment

  • Prices are in Australian dollars and exclude GST, which is added at checkout.
  • The one-off setup fee ($750 + GST) pays for the setup work: discovery, your brand brief, connecting your accounts, building your avatar and voice where your plan includes video, and tuning Tella. Once that work has started, the setup fee isn't refundable, except where the law requires.
  • Monthly plans are billed in advance and start after setup. Each plan's allowance applies per calendar month (Melbourne time) and unused allowance doesn't carry over. Failed posts don't count.
  • If your allowance runs out, Tella tells you; extra allowance can be arranged with us.
  • On the Unlimited plan, you pay your own AI providers directly under their terms.
  • We'll give you at least 30 days' notice before changing the price of your plan.

10. Cancelling

You can cancel your plan at any time by emailing or messaging us. Cancellation takes effect at the end of the month you've paid for, and we don't refund part-months, except where the law requires. We may suspend or end your account if you seriously or repeatedly break these terms, or don't pay; where we reasonably can, we'll warn you first. When an account ends, we handle your data as the privacy policy describes.

11. Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or other laws that can't be excluded. Where we're allowed to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

12. Limits of our liability

Subject to section 11, we provide Tella with reasonable care and skill but don't promise it will be uninterrupted, error-free, or produce any particular reach, engagement or sales. To the extent the law allows, we're not liable for indirect or consequential loss (such as lost profits or reputation), or for loss caused by posts you approved, by your content, or by third-party services, and our total liability to you is limited to the fees you paid us in the 3 months before the claim arose.

You agree to cover us for claims made by others because of content you sent or approved, or your breach of these terms.

13. Changes to these terms

We may update these terms. We'll show the date at the top, and tell you in the app or by email before a material change takes effect. If you keep using Tella after that, the new terms apply; if you don't agree, you can cancel.

14. General

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction. If part of these terms can't be enforced, the rest still applies. Questions about these terms: [email protected].
